What are trust lands?

Trust lands are parcels of land granted by Congress to Utah at statehood to support specific beneficiaries, including public schools, universities, hospitals, and reservoirs.  Trust lands are not public lands, but are generally open for public use, when possible.  Trust lands were allocated specifically to generate revenue to support our beneficiaries.  SITLA currently manages 3.4 million surface acres on behalf of our beneficiaries.

ONLINE BIDDING INFORMATION AND FINANCING:

This property will be sold online through a sealed bid process with the assistance of EnergyNet, our service provider for this sale.
Bids will be accepted from November 9 at 9am through November 16, 2021 at Noon (MST).  
All bids are considered an offer to purchase and cannot be reduced or withdrawn.
The successful bidder will be required to pay the closing costs and a 2% bid deposit within 48 hours of the closing of bidding (by November 18 @ Noon).  The required remaining 23% down payment or payment in full (as applicable) will be due by Tuesday, December 14 at 5pm (MST). 
Financing will be offered for this parcel at a variable interest rate of prime plus 2.5% or 7.5%, whichever is greater.  The remaining balance can be financed for up to a 20 year term with annual payments.

Closing Costs:

The closing costs are in addition to the 25% down payment.  All closing costs are due from the prevailing bidder within 48 hours after the close of the bidding and cannot be financed.

The net proceeds from the sale of this property will be deposited into the permanent funds for the beneficiaries of Public Schools, Reservoirs, and the University of Utah.

Location:

This large block is located west of Ant Flat Road, just north of the Cache/Weber County boundary line.  Cinnamon Creek runs through the property.

Access:

Legal access to the property is from the southern side of the parcel through an reciprocal easement agreement that will be transferred with the property (Predesignation No. 620).  Another physical access point  is on the eastern side of the parcel through property owned by the Utah Division of Wildlife Resources.

Additional Information:

The terrain is varied and includes level, gently sloping, moderately sloping, steep, and very steep topography.  There is a large ravine that runs east to west through the southern side of the parcel, where Cinnamon Creek is located.  Sheep Creek Canyon runs along the northerly boundary and Red Rock Creek runs along the southerly boundary.  Powder Mountain Ski Resort is about four miles southwest of the parcel.

Water Rights:

The following water rights are located on the property and will be included with the sale:  25-1901, 25-1902, 25-1903, 25-1904, 25-1905, 25-1906, 25-1907, 25-1908, 25-1909, 25-1910, 25-1911, and 25-575.  These water rights are all diligence claims tied to small springs and streams located throughout the property.  Collectively, these water rights are part of two water use groups where the allowed use under one group is the stockwatering of 400 equivalent livestock units (in cattle, horses, or equivalent species) and the allowed use under the other group is one equivalent domestic unit (part-time domestic uses of one family).  Both groups have periods of use from May 1 to October 31 of each year.  Please contact the Utah Division of Water Rights for more information on these water rights.

Cultural Resource Covenant:

A cultural resource survey was conducted on this parcel.  The parcel will be sold with cultural reservations for the significant sites which were identified.

Disclosures:

  1. Additional disclosures and conveyance documents will be provided prior to the bid opening date.
  2. All mineral rights, except the sand and gravel rights will be reserved.
  3. The Utah Geological Survey (UGS) has submitted the following comment:  “Potential geologic hazards in the area that could affect the block include flash flooding/debris flow, problem soils and/or bedrock including shrink/swell, and/or collapsible, landslides and landslide-prone geologic units, shallow bedrock, karst, and indoor radon potential.
